Allergen guidance update – FSA draft allergen guidance

The Food Standards Agency (FSA) has published its best-practice guidance on providing allergen information for non-prepacked foods. The guidance reflects growing consumer expectations for greater transparency and follows increasing scrutiny of allergen management across the food industry.

While the guidance does not currently introduce new legal requirements, it sets out the standards that the FSA believes food businesses should work towards when communicating allergen information to customers.

The overall message is clear: consumers should be able to access allergen information easily, in writing and through informed conversations with staff, enabling them to make safe and informed choices.

In this article, we explore some of the key themes within the guidance and what they could mean for food businesses.

Does the FSA Guidance Require Written Allergen Information?

The FSA’s preferred approach is that allergen information should be:

  • Available in writing.
  • Supported by a conversation with staff.

The guidance recognises that conversations remain an important part of allergen management, particularly where customers have complex dietary requirements or where additional precautions may be needed.

However, the direction of travel is clear. The FSA believes that written allergen information should become more readily available to consumers, reducing reliance on verbal communication alone.

For businesses that currently depend solely on staff providing allergen information on request, this may require a review of existing systems and procedures.

Is This a Legal Requirement?

No. The guidance represents best practice rather than new legislation.

However, businesses should not dismiss it as merely optional advice.

Best-practice guidance often influences the expectations of:

The guidance also provides insight into the direction future legislation may take, particularly given ongoing discussions around Owen’s Law and improving allergen transparency across the food sector.

One notable theme within the guidance is the expectation that allergen information should be easily accessible and that customers should be able to discuss their requirements confidently with staff.

This may place greater responsibility on front-of-house teams and increase the need for robust allergen awareness training.

Businesses should consider:

  • Whether staff understand allergen risks.
  • How allergen enquiries are handled.
  • Who is responsible for providing allergen information.
  • When enquiries should be escalated to a manager or allergen lead.
  • How information is kept accurate and up to date.

The guidance reinforces the importance of ensuring staff have both the knowledge and confidence to support customers with food allergies.

Does the Guidance Go Beyond the 14 Mandatory Allergens?

The UK legal requirement remains focused on the 14 regulated allergens.

However, the guidance recognises that some consumers may have allergies to foods outside the mandatory list and may ask for additional ingredient information.

For some businesses, particularly those selling loose foods, obtaining and maintaining comprehensive ingredient information may be challenging.

While there is no legal requirement to provide information on every potential allergen, businesses should consider how they will respond to requests for information beyond the regulated 14 allergens.

Digital or Paper-Based Allergen Information?

Many food businesses now rely on digital allergen management systems, online menus and cloud-based recipe databases.

The guidance emphasises that allergen information should be easily available to consumers but also recognises the importance of accessibility.

The key consideration is not whether information is digital or paper-based, but whether it is:

  • Easy for customers and staff to use.

Businesses using digital systems should review whether customers can access allergen information quickly and whether contingency arrangements are in place if systems become unavailable.

Should Menus Include Full Ingredient Information?

The guidance encourages transparency but does not require every menu to contain a complete ingredient breakdown.

Providing detailed ingredient information can help customers make informed decisions, but it also creates practical challenges.

Clear allergen communication can help customers identify suitable options more easily and improve confidence when ordering.

When displaying allergen information, businesses should ensure that:

  • Information is accurate and regularly reviewed.
  • Customers know where to find additional details.
  • Staff can explain allergen information if required.
  • Systems are in place to manage recipe changes.

Whatever format is used, consistency and clarity are essential.

What Should Food Businesses Do Now?

Although the guidance does not create new legal requirements, it provides a strong indication of the standards that regulators and consumers increasingly expect.

Food businesses should take the opportunity to review:

  • Allergen information systems.
  • Menu and allergen matrix accuracy.
  • Staff training programmes.
  • Customer communication processes.
  • Online allergen information.
  • Procedures for managing allergen enquiries.

Businesses that adopt these best-practice recommendations now will be better positioned to meet future expectations and demonstrate a proactive commitment to customer safety.
